المستخلص: هدفت هذه الدراسة إلى بيان مفهوم التلفيق في الاجتهاد والتقليد، والكشف عن أحكامه وضوابطه وآثاره في الفقه الإسلامي، مع إبراز مدى إمكان الاستفادة منه في معالجة القضايا المعاصرة ومراعاة حاجات الناس المتجددة. واعتمدت الدراسة المنهج الاستقرائي التحليلي المقارن؛ من خلال تتبع أقوال الأصوليين والفقهاء، وتحليل أدلتهم، ومقارنة اتجاهاتهم في حكم التلفيق، ثم الترجيح بينها. وتناولت الدراسة مفاهيم التلفيق والاجتهاد والتقليد، والفرق بين التقليد والاتباع، كما عرضت آراء العلماء في حكم التلفيق في التقليد، التي تراوحت بين الجواز المطلق، والجواز المقيّد، والجواز عند الحاجة، والمنع. كذلك بحثت حكم التلفيق في الاجتهاد وما ينشأ عنه من إحداث قول ثالث، وبيّنت شروط الأخذ بالتلفيق والمبادئ التي تحكم اختيار أصلح الآراء الفقهية، إلى جانب نماذج من تطبيقاته المعاصرة. وتوصلت الدراسة إلى أن التلفيق في التقليد يختلف عن التلفيق في الاجتهاد بحسب صفة القائم به؛ فإن صدر عن المجتهد كان تلفيقًا في الاجتهاد، وإن صدر عن المقلد كان تلفيقًا في التقليد. كما خلصت إلى رجحان جواز التلفيق في التقليد بضوابط تمنع تتبع الرخص والتلاعب بالأحكام، وتحول دون مخالفة الإجماع أو الوصول إلى صورة لم يقل بصحتها أحد من المجتهدين. أما التلفيق في الاجتهاد، فقد رجحت الدراسة جواز إحداث قول ثالث إذا لم يرفع ما اتفقت عليه الأقوال السابقة أو يخالف إجماعًا مستقرًا. وأكدت النتائج أن التلفيق المنضبط يسهم في تحقيق اليسر، ورفع الحرج، ومراعاة المصالح والحاجات المعاصرة، مع ضرورة التزام مقاصد الشريعة وعدم الأخذ بالأقوال الشاذة أو الضعيفة.

Abstract: This study aimed to clarify the concept of talfiq (combining rulings from different Islamic legal schools) in ijtihad and taqlid, examine its rulings and governing conditions, and explore its implications for Islamic jurisprudence. It also sought to demonstrate the potential role of talfiq in addressing contemporary issues and accommodating people’s evolving needs. The study employed inductive, analytical, and comparative approaches by examining the views of scholars of Islamic jurisprudence and legal theory, analyzing their evidence, comparing their positions on the permissibility of talfiq, and identifying the most preponderant opinions. It discussed the concepts of talfiq, ijtihad, and taqlid; distinguished between taqlid and following an opinion based on knowledge of its evidence; and presented scholarly views on talfiq in taqlid, which ranged from absolute permissibility and conditional permissibility to permissibility in cases of necessity and complete prohibition. It also examined talfiq in ijtihad and the resulting formulation of a third legal opinion, while outlining the conditions governing talfiq, the principles for selecting the most appropriate juristic opinions, and examples of its contemporary applications. The study concluded that talfiq in taqlid differs from talfiq in ijtihad according to the legal capacity of the person undertaking it. It favored the permissibility of talfiq in taqlid, provided that it is governed by conditions preventing the pursuit of concessions, manipulation of legal rulings, violation of scholarly consensus, or the creation of a composite practice whose validity is recognized by no qualified jurist. Regarding talfiq in ijtihad, the study favored permitting the formulation of a third opinion when it neither nullifies a point agreed upon in previous opinions nor contradicts an established consensus. The findings further emphasized that properly regulated talfiq can promote ease, alleviate hardship, and accommodate contemporary interests and needs, while remaining consistent with the objectives of Islamic law and avoiding anomalous or weak opinions.
