المستخلص: يهدف هذا البحث إلى تحقيق «باب حد الزنا» من كتاب شرح التنبيه للإمام بدر الدين الزركشي (ت 794هـ)، وإبراز منهجه في شرح متن التنبيه لأبي إسحاق الشيرازي وتحرير مسائل المذهب الشافعي. اعتمد البحث منهج التحقيق العلمي للمخطوطات؛ فتحقق من عنوان الكتاب ونسبته إلى مؤلفه، ووصف نسخه الخطية، وقابل نص الباب في نسختين متاحتين، ثم أثبت النص المختار وأشار إلى فروق النسخ في الحواشي. كما وثّق النقول والأقوال من مصادرها، وخرّج الأحاديث والآثار، وعرّف بالأعلام والمواضع، وشرح الألفاظ التي تحتاج إلى بيان. وأظهر النص المحقق عناية الزركشي بضبط شروط الحد والإحصان، وبيان أثر الشبهة في درء الحد، وعرض الأقوال والأوجه داخل المذهب مع الاستدلال والمناقشة. وتناول كذلك أحكام إثبات الحد وإقامته، وما يُراعى عند تنفيذه من أحوال المحكوم عليه. ويتيح تحقيق هذا الباب نصًا فقهيًا موثّقًا يعين الباحثين على دراسة اختيارات الزركشي وطريقته في شرح أحد المتون المعتمدة في الفقه الشافعي.

Abstract: This study presents a critical edition of the chapter on the prescribed punishment for zina from Sharh al-Tanbih by Badr al-Din al-Zarkashi (d. 794 AH). It aims to examine his approach to explaining Abu Ishaq al-Shirazi’s al-Tanbih and clarifying legal issues within the Shafi‘i school. Following established methods of manuscript editing, the study verifies the book’s title and attribution, describes its manuscript copies, and compares the chapter as preserved in two relevant copies. It establishes an edited text and records textual variants in the footnotes. The study also verifies quotations and juristic opinions against their sources, traces hadith reports and transmitted accounts, identifies individuals and places, and explains unfamiliar terms. The edited text demonstrates al-Zarkashi’s attention to the conditions governing the prescribed punishment and the legal status of ihsan, as well as the effect of legal doubt in averting the punishment. It also shows how he presents, supports, and discusses differing opinions within the Shafi‘i school. The chapter further addresses the proof and administration of the punishment and the circumstances to be considered in its implementation. This edition makes an annotated juristic text available for the study of al-Zarkashi’s legal reasoning and his commentary on a major Shafi‘i text.
