المستخلص: يهدف هذا البحث إلى دراسة التكيف القانوني لمكافحة جريمة الإرهاب، من خلال تحليل التشريعات الوطنية والدولية، والتحديات القانونية التي تواجه الجهود المبذولة لمكافحة هذه الجريمة، مع تقديم مقترحات لتطوير الأطر القانونية بما يحقق الفعالية مع احترام حقوق الإنسان. يبدأ البحث بتوضيح مفهوم جريمة الإرهاب من الناحية القانونية، حيث يُلاحظ عدم وجود تعريف موحد للإرهاب في القوانين الدولية والوطنية، مما يؤثر على الجهود المبذولة في مكافحته. كما يستعرض أركان الجريمة الإرهابية، وأشكالها التقليدية والحديثة، مثل الإرهاب السيبراني وتمويل الإرهاب. ثم يناقش البحث الإطار القانوني لمكافحة الإرهاب، متناولًا القوانين الوطنية لمكافحة الإرهاب في بعض الدول العربية والغربية، ومدى توافقها مع الاتفاقيات الدولية، مثل الاتفاقية العربية لمكافحة الإرهاب واتفاقيات الأمم المتحدة. كما يسلط الضوء على الإجراءات القانونية المتبعة لملاحقة مرتكبي الجرائم الإرهابية، سواء من خلال القوانين الداخلية أو التعاون الدولي عبر الإنتربول والمحاكم الجنائية الدولية. يتناول البحث أيضًا التحديات القانونية في مكافحة الإرهاب، مثل غياب تعريف موحد، وصعوبة جمع الأدلة بسبب تطور أساليب الإرهاب، والتحديات التي تواجه الدول في تحقيق التوازن بين الأمن وحماية حقوق الإنسان، خاصة مع استخدام بعض الدول قوانين مكافحة الإرهاب كذريعة للتضييق على الحريات. وفي القسم الأخير، يقدم البحث مقترحات لتطوير التشريعات لمكافحة الإرهاب بفعالية، من خلال تحديث القوانين الوطنية لمواكبة المستجدات، وتعزيز التعاون الدولي في تبادل المعلومات الأمنية، وضمان أن تكون القوانين متوازنة بحيث تحافظ على الأمن دون انتهاك الحقوق الأساسية للأفراد.

Abstract: This research aims to examine the legal adaptation to combating the crime of terrorism, by analyzing national and international legislation and the legal challenges facing efforts to combat this crime. It also presents proposals for developing legal frameworks to achieve effectiveness while respecting human rights. The research begins by clarifying the concept of the crime of terrorism from a legal perspective, noting the lack of a unified definition of terrorism in international and national laws, which impacts efforts to combat it. It also reviews the elements of the terrorist crime and its traditional and modern forms, such as cyberterrorism and terrorist financing. The research then discusses the legal framework for combating terrorism, examining national counterterrorism laws in some Arab and Western countries and their compatibility with international agreements, such as the Arab Convention for the Suppression of Terrorism and United Nations conventions. It also sheds light on the legal procedures followed to prosecute perpetrators of terrorist crimes, whether through domestic laws or international cooperation via Interpol and the International Criminal Courts. The research also addresses the legal challenges in combating terrorism, such as the lack of a unified definition, the difficulty of collecting evidence due to the evolution of terrorist methods, and the challenges facing states in balancing security and human rights protection, especially with some states using counterterrorism laws as a pretext to restrict freedoms. In the final section, the research presents proposals for developing legislation to effectively combat terrorism, by updating national laws to keep pace with developments, enhancing international cooperation in the exchange of security information, and ensuring that laws are balanced to maintain security without violating the fundamental rights of individuals.
